While not every client will need a sophisticated estate plan involving estate tax planning, it is critical that clients have a will to insure that their estate is distributed as they would wish and that the assets of their estate are managed properly. Otherwise, in the absence of a will, a decedent's estate will be administered and distributed in accordance with default rules established by the state. Those default rules often provide for a much different division of the property of the estate than the deceased would have assumed or preferred. Use of a will allows an individual to set out their wishes in clear terms, and a will can be updated, amended, or replaced as often as necessary as a person's situation or wishes change.

Furthermore, for clients with minor children, a will can be useful for establishing a trust at your death to manage the assets of your estate until the children are old enough to receive the assets and manage them themselves. One might also use a will to name a guardian for the children in case both parents were to die while the children are still minors.
